കേരളത്തിലെ പട്ടയ ഭൂമിയിൽ (Assigned Land) ക്വാറി പ്രവർത്തനം: റെഗുലറൈസേഷൻ ചട്ടങ്ങളും Standard Operating Procedure (SOP) യും – നിയമപരമായ വിശദീകരണം
കേരള
സർക്കാർ കാർഷിക ആവശ്യങ്ങൾക്കായി അനുവദിച്ച പട്ടയ ഭൂമിയിൽ ക്വാറി അഥവാ ഖനന പ്രവർത്തനം നടത്തുന്നത് പൊതുവേ നിയമവിരുദ്ധമാണ്. ഈ
നിയമനിലപാട് വ്യക്തമാക്കുന്ന നിരവധി കോടതി ഉത്തരവുകൾ നിലവിലുണ്ട്. ഇതിന്റെ
പശ്ചാത്തലത്തിൽ, പട്ടയ
ഭൂമിയിൽ പ്രവർത്തിച്ചിരുന്ന നിരവധി ക്വാറികൾ പ്രവർത്തനം നിർത്തേണ്ട സാഹചര്യം
സംസ്ഥാനത്ത് ഉണ്ടായി.
എന്നാൽ, 07-06-2024 ന് മുൻപ് നിലവിലുണ്ടായിരുന്ന ചില പ്രത്യേക സാഹചര്യങ്ങളിലെ പട്ടയ വ്യവസ്ഥാലംഘനങ്ങൾ പരിഹരിക്കുന്നതിനായി സർക്കാർ “കേരള സർക്കാർ ഭൂമിപതിവ് (വ്യവസ്ഥാലംഘനങ്ങളുടെ ക്രമവൽക്കരണം) ചട്ടങ്ങൾ, 2025/Kerala Government Land Assignment (Regularization of Contraventions) Rules, 2025” എന്ന നിയമവും അതിനനുസൃതമായ Standard Operating Procedure (SOP) യും പുറത്തിറക്കിയിട്ടുണ്ട്.
ഈ
ചട്ടങ്ങൾ പുതിയ ക്വാറി അനുവദിക്കുന്നതിനുള്ള നിയമമല്ല. മറിച്ച്, മുൻകാലത്ത് നടന്ന ചില നിയമവിരുദ്ധ
ഭൂമി ഉപയോഗങ്ങൾ സർക്കാർ തലത്തിൽ നിയമപരമായി തീർപ്പാക്കുന്നതിനുള്ള ഒരു പ്രത്യേക
ഇളവായി മാത്രമാണ് ഇവ നിലനിൽക്കുന്നത്.
1. റെഗുലറൈസേഷൻ
പരിഗണിക്കപ്പെടുന്ന ക്വാറികൾ – അടിസ്ഥാന നിബന്ധനകൾ
പട്ടയ
ഭൂമിയിലെ quarry പ്രവർത്തനം
റെഗുലറൈസ് ചെയ്യുന്നതിനായി താഴെപ്പറയുന്ന നിബന്ധനകൾ എല്ലാം നിർബന്ധമായും
പാലിക്കപ്പെട്ടിരിക്കണം.
ക്വാറി പ്രവർത്തനം 07-06-2024 ന് മുൻപ് ആരംഭിച്ചിരിക്കണം. ക്വാറി ആരംഭിക്കുന്നതിനാവശ്യമായ
permits അല്ലെങ്കിൽ
licenses ലഭിച്ചിട്ടുണ്ടാകണം,
അല്ലെങ്കിൽ എല്ലാ ആവശ്യമായ permits/licenses
നേടിയശേഷം quarry പ്രവർത്തനം ആരംഭിച്ചിരിക്കണം. ക്വാറി നടന്ന
ഭൂമി Schedule-I ൽ
ഉൾപ്പെടുന്ന പട്ടയ ചട്ടങ്ങൾ പ്രകാരം അനുവദിക്കപ്പെട്ടതായിരിക്കണം.
07-06-2024 ന് ശേഷം
ആരംഭിച്ച ക്വാറി കൾക്ക് ഈ ചട്ടങ്ങൾ ബാധകമല്ല.
2. Schedule-I പ്രകാരം ഉൾപ്പെടുന്ന പട്ടയ ഭൂമികൾ
താഴെപ്പറയുന്ന
പതിനൊന്ന് Assignment Rules പ്രകാരം
അനുവദിച്ച പട്ടയ ഭൂമികളിലാണ് ക്വാറി സംബന്ധിച്ച വ്യവസ്ഥാലംഘനങ്ങൾ
റെഗുലറൈസേഷൻക്ക് പരിഗണിക്കുന്നത്.

3. ക്വാറി റെഗുലറൈസേഷൻ
– ഏത് ഫോറം ബാധകം
പട്ടയ
ഭൂമിയിൽ quarry, mining, industrial, commercial ഉപയോഗങ്ങളുമായി ബന്ധപ്പെട്ട എല്ലാ തരത്തിലുള്ള
വ്യവസ്ഥാലംഘനങ്ങൾക്കും Form D ആണ് ബാധകമായ അപേക്ഷാ ഫോറം.
Form D-ൽ
പ്രധാനമായി നൽകേണ്ട വിവരങ്ങളിൽ പട്ടയം അനുവദിച്ചിട്ടുള്ള മൂല ലക്ഷ്യം, ക്വാറി പ്രവർത്തനം ആരംഭിച്ച തീയതി,
quarry നടത്തിയ ഭൂമിയുടെ യഥാർത്ഥ വിസ്തൃതി,
ലഭിച്ചിട്ടുള്ള permits,
licenses, clearances എന്നിവയുടെ
വിശദാംശങ്ങൾ എന്നിവ ഉൾപ്പെടുന്നു.
4. യഥാർത്ഥമായി
ക്വാറിക്കായി ഉപയോഗിച്ച
വിസ്തൃതി മാത്രമേ റെഗുലറൈസ് ചെയ്യൂ
റെഗുലറൈസേഷൻ
നടപടികളിൽ field inspection, satellite imagery, revenue records എന്നിവ ഉപയോഗിച്ച് ക്വാറി പ്രവർത്തനം
നടന്ന യഥാർത്ഥ ഭൂമി വിസ്തൃതി മാത്രമാണ് സ്ഥിരീകരിക്കുന്നത്.
Kerala Government Land Assignment (Regularization of
Contraventions) Rules, 2025 ലെ Rule
6(1) പ്രകാരം, റെഗുലറൈസേഷൻ വ്യവസ്ഥാലംഘനം നടന്ന extent-നോട് മാത്രം
ബന്ധിപ്പിച്ചിരിക്കുന്നു. അതുപോലെ Schedule II(b), Item 5(b) ൽ quarrying operations
carried on ചെയ്ത ഭൂമിയുടെ extent-നാണ് റെഗുലറൈസേഷൻ ഫീസ്
ബാധകമാകുന്നതെന്ന് വ്യക്തമായി വ്യക്തമാക്കുന്നു.
അതായത്,
പട്ടയത്തിലെ മുഴുവൻ വിസ്തൃതി automatic
ആയി regularize ചെയ്യുകയില്ല. Quarry നടന്ന ഭൂമി ഉപയോഗിച്ച ഭാഗം മാത്രം
ക്രമവൽക്കരിക്കുന്നതാണ്.
5. റെഗുലറൈസേഷൻ
ഫീസ് – Schedule II(b)
Quarry, industrial, commercial contravention സംബന്ധിച്ച് Schedule II(b),
Item 5(b) പ്രകാരം fair value-യുടെ 50 ശതമാനം റെഗുലറൈസേഷൻ ഫീസായി
ഈടാക്കപ്പെടും. ഈ ഫീസ് quarry പ്രവർത്തനം നടന്ന യഥാർത്ഥ extent-നു മാത്രമേ ബാധകമാകുകയുള്ളു.
Fair value നിർണ്ണയം
രജിസ്ട്രേഷൻ വകുപ്പിൽ നിലവിലുള്ള ഫെയർ വാല്യൂ അനുസരിച്ചായിരിക്കും.
6. പ്രധാന
നിയമപരമായ നിയന്ത്രണങ്ങൾ
പട്ടയ
ഭൂമിയിൽ പുതിയ ക്വാറി അനുവദിക്കുന്നതിന്
നിലവിലെ ചട്ടങ്ങളിൽ വ്യവസ്ഥയില്ല. ഈ റെഗുലറൈസേഷൻ ഭാവിയിൽ quarry നടത്താനുള്ള അവകാശം
സൃഷ്ടിക്കുന്നതുമല്ല. Mining Act, Environment Clearance, Pollution
Control, Explosives Act തുടങ്ങിയ
മറ്റ് നിയമങ്ങളുടെ ലംഘനങ്ങൾ ഇതിലൂടെ regularize ചെയ്യപ്പെടുന്നില്ല.
ഈ
ചട്ടങ്ങൾ ഭൂമി ഉപയോഗമാറ്റം സംബന്ധിച്ച പട്ടയ വ്യവസ്ഥാലംഘനങ്ങൾക്കു മാത്രമാണ്
ബാധകം. ക്വാറിയുടെ കേസുകളിൽ കർശനമായ ഫീൽഡ് പരിശോധന
നിർബന്ധമാണ്. സർക്കാർ അംഗീകാരം ലഭിച്ചാൽ മാത്രമേ റെഗുലറൈസേഷൻ അനുവദിക്കുകയുള്ളു.
7. Undertakingയും റെഗുലറൈസേഷൻ റദ്ദാക്കാനുള്ള അധികാരവും
Form D പ്രകാരം quarry
റെഗുലറൈസേഷൻ അനുവദിക്കുന്ന
സാഹചര്യത്തിൽ, അപേക്ഷകൻ
100 രൂപ മൂല്യമുള്ള non-judicial
stamp paper-ൽ undertaking നൽകേണ്ടതാണ്. ഭാവിയിൽ വ്യവസ്ഥാലംഘനം
ഉണ്ടാകില്ലെന്ന് ഇതിലൂടെ അപേക്ഷകൻ സമ്മതിക്കുന്നു.
തെറ്റായ
വിവരങ്ങൾ നൽകുക, വസ്തുതകൾ
മറച്ചുവയ്ക്കുക, അല്ലെങ്കിൽ
തെറ്റിദ്ധരിപ്പിക്കൽ നടത്തുക തുടങ്ങിയ കാര്യങ്ങൾ കണ്ടെത്തിയാൽ, സർക്കാർ ഏത് സമയത്തും റെഗുലറൈസേഷൻ
ഉത്തരവ് റദ്ദാക്കാനുള്ള പൂർണ്ണ അധികാരം നിലനിൽക്കുന്നു.
8. റെഗുലറൈസേഷൻ
– അവകാശമല്ല, പ്രത്യേക
ഇളവാണ്
ഈ
ചട്ടങ്ങൾ ക്വാറി ഉടമകൾക്ക് അവകാശം നൽകുന്ന നിയമമല്ല. മുൻകാലത്ത്
ഉണ്ടായ ചില പ്രത്യേക സാഹചര്യങ്ങൾ നിയമപരമായി തീർപ്പാക്കുന്നതിനുള്ള സർക്കാർ ഇളവാണ്
ഇത്.
അതുകൊണ്ട്
ഓരോ അപേക്ഷയും പ്രത്യേകം പരിശോധിച്ച്, ഓരോ കേസും case-by-case അടിസ്ഥാനത്തിൽ, വിശദമായ പരിശോധനയ്ക്ക് ശേഷമാണ്
സർക്കാർ തീരുമാനം എടുക്കുന്നത്.
