 Biju K Varghese vs Geologist 

 When a quasi-judicial body embarks on determining the rights of parties, adherence to the principles of natural justice is of supreme importance. The first and foremost among the said principles is the principle commonly known as audi alteram partem, viz, that no man should be condemned unheard.

(This judgment provides guidelines on the actions to be taken by a Geologist/Assistant Geologist when an offence is detected. These include writing the mahazzar, drafting notices, the importance of hearings, and the significance of adjudicating orders.)

 The statutory authorities while passing final orders in appeal, revision and other proceedings after conclusion of hearing, a time limit should be followed. Hon'ble High Court issued guidelines: after hearing the statutory authorities should pass final orders within 30 days from the date of concluding the hearing. (This is applicable for all statutory authorities including Geologists/Asst. Geologists.)

Under Section 3(26) of the General Clauses Act and Section 2(6) of the Registration Act, trees are regarded as immovable property. Therefore, any interest created by an agreement to tap latex from rubber trees requires registration. (Based on this judgment, it is evident that any agreement between a landowner and a lessee, if not registered, is null and void.)
